Terms of use

1. Purpose

These terms govern use of Prestaday, published by [à compléter : entityName]. Creating an account accepts these terms and the data-processing agreement (DPA). Subscription sales terms (CGV) are a separate document, accepted only when you start a paid subscription.

2. The service

Prestaday is a management tool for photography and video professionals: quotes, contracts and electronic signature, schedules, invoices, calendars, and a client portal. The service is provided as it stands, with the changes and fixes we ship.

3. Account

You are responsible for the accuracy of the information you provide, for keeping your password confidential, and for what is done from your account. Confirming your email address is required to use the service. Tell us promptly about any unauthorized access.

4. Your content

You keep ownership of everything you upload: client data, documents, photographs, text. We access it only as needed to run the service, keep it secure, or answer a support request you made. We do not use it for other purposes and we do not sell it.

5. Prohibited use

• Upload unlawful content, or infringe someone else's rights.
• Try to reach another organization's data, or bypass access controls.
• Use the service to send unsolicited bulk messages.
• Disrupt the service or test its security without written permission.

6. Availability

We aim for continuous availability and do not guarantee it. Interruptions can happen for maintenance, updates, or a provider failure.

7. Beta program

While the service is in beta, the following also applies:

• No service level. No uptime, response time, or on-call coverage is promised. Features may appear, change, or disappear without notice.
• Product confidentiality. What you see before a public announcement (screens, unpublished prices, defects) stays confidential. Do not publish it and do not share it with a competitor. This does not cover information that is already public.
• Feedback. Your feedback helps. You are not contractually required to file a report, and we may use it to improve the service without paying you.
• Test data. We recommend fictional projects and clients during the beta. If you enter real data, you remain the controller and the data-processing agreement applies.
• Free of charge. No payment method is asked for the Prestaday subscription. Access granted by hand is not a paid subscription. The sales terms apply on the day you subscribe to a paid plan, not before.

8. Liability

You are responsible for your duties toward your own clients, including the commercial and tax validity of documents you issue from the service. We provide the tool. We do not draft your contracts and we do not replace your legal or accounting advice.

9. Termination

You can delete your account or your organization at any time from the application. We may suspend an account for a serious breach of these terms, after notice except in an emergency. After deletion, your data is erased subject to the legal retention periods described in the privacy policy.

10. Changes

These terms can change. A material change is shown in the application before you continue, when the published revision requires it. A minor correction updates the page without a new acceptance.

11. Governing law

French law. If we cannot resolve a dispute amicably, the courts of the publisher's registered office have jurisdiction.
